What Are the Employer’s Obligations?
The employer is required to insure their employees against the risk of “occupational accidents” at their own expense. This obligation arises if the NACE code (National Classification of Economic Activities code) of the company is included in the official decree for determining the Coefficient of Occupational Injuries by economic activities. This decree is issued annually (usually at the end of October or in November) by the Minister of Labor and Social Policy and is valid for the following calendar year..
Where Is It Stated?
- Regulation on Mandatory Insurance of Employees Against Occupational Accident Risk
- Article 52 of the Health and Safety at Work Act
What Should I Do?
- Check Whether Your Company’s NACE Code Is Included in the Current Decree:
– If your company’s NACE code is not listed in the decree, you are not obliged to insure your employees against occupational accident risks.
– If your company’s NACE code is included in the decree, you are obliged to provide such insurance for the next calendar year. - Steps to Take If Your NACE Code Is Included:
– Conduct consultations with the occupational health service and the health and safety committee/group. These consultations must be documented in a protocol.
– Issue and approve a written order specifying the employees who are subject to mandatory insurance for the relevant calendar year.
– Sign an insurance contract with an insurer licensed to provide mandatory insurance. - What Does the Insurance Cover?
The insurance covers the risks of death, permanent disability, or temporary incapacity resulting from an occupational accident.
